    • Acte : # 10065
    • Date : 4 novembre 1870
    • Notification and Protest at the request of Ozro Morrill, Trader, Harris Way, Gentleman, George W. White, Trader (from N. Y.), Benjamin Thrasher Morrill, Iron Founder, and others upon Levi Spalding Esquire residing in the Town of Derby (Vt.).
      • Résumé : La série de commerçants de Rock Island, propriétaires de terrains et de magasins : « …bounded on the East by the highway leading from Stanstead Plain to Derby Line, on the South by land and Store owned by the said Levi Spalding and now occupied by one Lyman Spalding and on the North by land and Building owned by the said Ozro Morrill and one Austin T. Foster of Derby aforesaid Trader, and now occupied by Carpenter & Pike as a Drug Store » souhaitent conserver l’accès à la ruelle à l’arrière de leurs propriétés (donc du côté Ouest). On précise que « …the said strip piece or parcel of land has been for a long term of years reserved by good and sufficient Title and Deed for the purpose of a Carriage way, passage and Driveway to and from the land premises and real property of said protesting parties ». La mésentente vient du fait que « …the said Levi Spalding without the permission or consent and contrary to the remonstrances and objections of the [protesting parties] […] and without any right or title to the said tract or parcel of land and premises, has entered upon and built or commenced to build and erect a stone foundation upon the said tract or parcel of land and premises and is about to raise a Building thereon, and has drawn and placed upon the said strip piece or parcel of land, a quantity of Stone and Timber for the purpose of the said Building, thereby obstructing the said Carriage way, Passage and Driveway, the whole to the great damage, detriment and injury of the said protesting parties. Wherefore I, the said Notary Public at the request aforesaid and speaking as aforesaid did demand and require he said Levi Spalding to desist from the erection of the said Building […] ».
